1 Platform Nature
KayaaKalp is solely a technology platform that enables users to discover and book beauty and wellness services offered by independent beauticians and service professionals. KayaaKalp itself does not directly provide beauty services, salon services, skincare treatments, or cosmetic procedures. All beauticians and service professionals listed on the platform operate independently and are not employees, agents, partners, or representatives of KayaaKalp.
2 Independent Service Providers
All services booked through the platform are performed solely by independent beauticians/service providers. The service provider is fully responsible for: Service quality, Hygiene and sanitation, Professional conduct, Product usage, Customer safety, and Compliance with applicable laws and regulations. KayaaKalp shall not be held responsible for the acts, omissions, negligence, misconduct, or performance of any independent beautician/service provider.
3 Product & Allergy Disclaimer
Users are solely responsible for informing the beautician about: Skin allergies, Medical conditions, Pregnancy, Sensitivities, Existing skin treatments, and Medication usage. KayaaKalp does not manufacture, test, sell, or guarantee any beauty/skincare products used during services.
KayaaKalp shall not be liable for: Skin reactions, Allergic reactions, Burns, Rashes, Infections, Hair damage, Cosmetic dissatisfaction, Injuries, Side effects, or Medical complications. Any liability arising from products or services shall rest solely with the respective beautician and/or product manufacturer.
4 User Responsibility
By booking a service, the user acknowledges and agrees that services are availed at their own discretion and risk, results may vary from person to person, beauty and skincare outcomes are subjective, and no guaranteed results are promised. Users are advised to perform patch tests before availing any chemical-based service.
5 Limitation of Liability
To the maximum extent permitted by law, KayaaKalp, its owners, directors, employees, affiliates, and partners shall not be liable for direct, indirect, incidental, or consequential damages, personal injury, loss of data, emotional distress, financial loss, medical expenses, or loss arising from service dissatisfaction. KayaaKalp’s total liability, under any circumstance, shall not exceed the amount paid by the customer for the booked service.
6 No Warranty
KayaaKalp provides the platform on an “as-is” and “as-available” basis without warranties of any kind. KayaaKalp does not guarantee service quality, availability, accuracy, timeliness, continuous platform operation, or specific beauty results.
7 Booking & Cancellation Policy
Bookings are subject to beautician availability. Users must provide accurate address and contact details. Advance payments may be non-refundable in certain cases. Cancellation/refund policies may vary depending on the service category. KayaaKalp reserves the right to refuse or cancel bookings in cases of suspected fraud, misuse, abuse, or policy violations.
8 Legal Jurisdiction
Any dispute, claim, or legal proceeding arising out of or related to the use of the platform or services shall be subject to the exclusive jurisdiction of the courts located in Mathura, Uttar Pradesh, India. Users agree that no legal action shall be initiated against KayaaKalp in any other jurisdiction or court.
9 Pricing & Offers
All prices, discounts, memberships, and promotional offers displayed on the platform are subject to change without prior notice. KayaaKalp reserves the right to modify prices, withdraw offers, change membership benefits, or correct pricing errors at any time.
10 Membership Terms
Membership plans and discounts are non-transferable and may be modified, suspended, or discontinued at the sole discretion of KayaaKalp. Membership benefits are subject to availability and applicable conditions.
11 User Conduct
Users shall not misbehave with beauticians, use abusive language, harass service providers, engage in fraudulent activities, or attempt unauthorized payments outside the platform. KayaaKalp reserves the right to suspend or permanently block users violating these terms.
12 Privacy & Data Usage
By using the platform, users consent to the collection and use of information including Name, Phone number, Address, and Booking details for operational, support, marketing, and service improvement purposes. KayaaKalp shall take reasonable measures to protect user data but cannot guarantee absolute security.
13 Force Majeure
KayaaKalp shall not be liable for any delay, cancellation, failure, or interruption caused by events beyond reasonable control including Natural disasters, Government restrictions, Internet failures, Pandemic situations, Technical outages, or Transportation issues.
14 Intellectual Property
All content, branding, logos, UI designs, graphics, text, and platform materials belong exclusively to KayaaKalp and may not be copied, reproduced, or used without written permission.
15 Right to Modify Terms
KayaaKalp reserves the right to update, modify, or replace these Terms & Conditions at any time without prior notice. Continued use of the platform constitutes acceptance of the updated terms.
16 Indemnification
Users agree to indemnify and hold harmless KayaaKalp, its owners, employees, and affiliates from any claims, damages, liabilities, legal proceedings, losses, or expenses arising from User misconduct, Violation of these terms, Service disputes, Third-party claims, or Improper use of the platform.
